JONES REAL ESTATE PRIVACY POLICY

Preamble

Jones Real Estate Pty Ltd (ACN 630 698 832) as trustee for Jones Real Estate Unit Trust (referred to in this Privacy Policy interchangeably as Jones Real Estate, we, us or our) respects your right to privacy and is committed to supporting the Australian Privacy Principles established under the Privacy Act 1988 (Cth) (the Act)[1]. Protecting your privacy and your Personal Information is very important to us.

The Jones Real Estate Privacy Policy (Privacy Policy) applies to all Personal Information as defined in the Act (Personal Information) collected by us. Generally, Personal Information is collected during the course of us providing services to clients, or otherwise via our website, social media channels, and direct marketing.

This Privacy Policy sets out in general terms matters of which you should be aware of relating to your privacy when dealing with us.

1. Collection of Personal Information

1.1. Whose information gets collected and how?

Jones Real Estate predominantly collects and uses Personal Information from our clients, users or visitors to our websites, and recipients of direct marketing materials. We may collect Personal Information from other people, entities, and sources from time to time.

1.2. What type of information gets collected?

The type of personal information that we collect and use generally depends on the type of dealings that you have with us and can include:

  • your date of birth, gender, and occupation where required for a stated purpose;
  • other personal information you give us when you receive service from us, including your requirements, opinions or preferences with respect to our services, payment details or your preferred payment method;
  • information contained in any communications between you and us;
  • information contained in any document given to us;
  • payment and transactional information regarding your acquisition and use of our services;
  • activity with our digital or online services; and
  • any information we are required to collect by law.

1.3. What Personal Information don’t we collect?

We do not deliberately collect Sensitive Information as defined under the Act without your express permission and consent. Sensitive Information is a subset of Personal Information under the Act, and includes:

  • information or an opinion about an individual’s racial or ethnic origin, political opinions;, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, sexual preferences or practices; or criminal record;
  • health information about an individual;
  • genetic information about an individual that is not otherwise health information;
  • biometric information that is to be used for the purpose of automated biometric verification or biometric identification, and biometric templates.

If we accidentally collect Sensitive Information from you we will inform you as soon as practicable, and take all reasonable steps to delete this information from our databases.

If for any reason we require Sensitive Information from you for the purpose of providing our service, we will seek your express consent to do obtain and use the Sensitive Information, and only use it for the purpose disclosed to you.

2. Security and Storage of Personal Information

2.1. What do we do to protect your Personal Information?

Jones Real Estate will take reasonable steps to protect our Personal Information received by us from any loss or theft, as well as from unauthorised access, disclosure, copying, use or modification, regardless of the format in which it is held. We will keep client personal data for as long as required, both as legally required and for the applicable purpose it is being used for.

Jones Real Estate has implemented policies and procedures to safeguard the secure storage and processing of data. We have verified, and regularly verify, the security arrangements of its outsourced data providers.

When you provide us with your Personal Information you give us your consent to store your Personal Information outside of Australia for the purposes described above.

2.2. How do we store your Personal Information?

The Personal Information we hold will be stored electronically in secure data centres located in Australia. We may transfer data outside of Australia to our service providers in order to obtain secure storage, back-up, and data retrieval services and to provide services.

We review the information we hold in these centres regularly and take reasonable steps to protect Personal Information from misuse, interference and loss, as well as unauthorised access, modification or disclosure. We will securely destroy or de-identify the Personal Information we hold once the information is no longer needed for any purpose for which the information may be used or disclosed under the Act.

2.3. How do you change or access your Personal Information?

If you require access, or want to correct your personal information, please contact Jones Real Estate via the contact details provided in paragraph 11.2. Once a request for access to Personal Information is received, we will require proof of identity. For most requests, the information will be provided free of charge, however a reasonable fee may be charged if your request requires a substantial effort on our part.

2.4. Disclaimer

While we make every effort to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party attacks from illegally obtaining this information.

By using our website you acknowledge that the internet is inherently insecure and we can only use our best endeavours to secure your personal information.

To the extent permitted by law we are not liable to you for any Loss suffered as a result of a third party attack, or leak of your Personal Information from our databases. Loss means any loss (including consequential loss), charge, outgoing, payment, cost, anticipated savings or bargain, expense or liability however incurred or suffered however arising (whether or not presently ascertained, immediate, future or contingent or in the nature of incidental, special, exemplary or consequential damages) including, but not limited to financial loss.

3. Use and Disclosure of Personal Information

3.1. How do we use your Personal Information generally?

Amongst other purposes, we may use the Personal Information we have collected for the purpose of responding to your enquiries, to advise you of an offering or service you have requested, and to help carry out our obligations arising from any contracts entered into between you and us.

Purchaser
  • We will request your Personal Information when you first express your interest to purchase a property from our listings.
  • Personal Information may be collected from you at an open for inspection, an auction, and a private sale process.
  • Your Personal Information will be recorded in the Contract of Sale or Offer provided to the vendor with copies retained by us.
  • Should we assist you in the purchase process we will communicate with you and keep a written record of our communication on the relevant property file.
Vendor
  • We will collect your Personal Information when we undertake an appraisal of your property, when you sign any sale documentation and during the course of the sale and marketing process.
  • We use your Personal Information to communicate with you during the appraisal of your property and the sale process, and we may use it to engage service providers to assist you to prepare your property for sale.
Landlord
  • Your Personal Information is collected when we are instructed to manage the lease or the marketing of the lease of your property, in your leasing and management documentation and whilst we manage the lease of your property.
  • We may use your Personal Information to communicate with you during the leasing process and throughout the period that we manage your property.
Tenant
  • Your Personal Information is collected when you make an enquiry online or physically, when you complete an application and during the term of your tenancy.
  • We may use your Personal Information to assess your application and carry out ongoing management of your tenancy.
Supplier or Contractor
  • We collect Personal Information of key personnel providing services to us, which may include name, contact details, ABN, insurance, and emergency contacts.
  • Your acceptance of a supply or service work order will constitute your express consent to our use of your Personal Information.
Job Seeker
  • You will need to provide information about your contact details, education, employment history, and other information to support your application.
  • Your application will constitute your express consent to our use of this information to assess your application and to allow us to carry out any required activities under applicable law as an employer.
Website User
  • When you visit our website, we may collect general information* about your visit which may include your server address, the date and time of your visit, the pages you accessed, the information you downloaded, and the type of Internet browser you used.
  • We may use this information in an anonymous, aggregated form, for statistical purposes, to assist us in improving the quality and usability of our website.

*We may also collect and process non-personal information provided to us by your browser when you visit our website or use our applications. If the information does not disclose your identity or enable your identity to be ascertained, it will in most cases not be classified as “personal information” and will not be subject to this Privacy Policy.

4. Disclosure of Personal Information to Third Parties

4.1. When will your Personal Information be provided to others?

Where permitted by the Act, Personal Information we collect about you may be disclosed to third parties as we determine necessary from time to time for any purpose necessary or directly in connection with the conduct of our business. including, but not limited to:

  • Any service provider we engage to carry out our business functions and activities;
  • Any third-party advertisers and marketers engaged including but not limited to websites such as domain.com.au, and realestate.com.au;
  • Our professional advisors and other contractors including but not limited to lawyers, accountants, IT consultants, research agencies and mailing houses;
  • Your professional advisors such as your solicitor or conveyancer;
  • Any person who introduces you to us. or who is acting as your referee or guarantor;
  • Your authorised agents or your executor. administrator or legal representative;
  • An organisation that has an arrangement or alliance with us e.g. for the purpose of promoting or using our respective goods or services or conducting a seminar or promotion;
  • Our business associates and others for purposes directly related to the purpose for which the personal information is collected;
  • Our related companies;
  • Organisations that conduct or promote charitable purposes or activities we proudly support;
  • Organisations that are involved in a transfer or proposed sale of our business or assets;
  • Any entity to which we are required or authorised under law to disclose such information including but not limited to Federal or State law enforcement agencies, investigative agencies and courts.

4.2. What do we do to ensure third parties don’t misuse your Personal Information?

We take steps to ensure that all third-party recipients are obliged to protect the privacy and security of your personal information and use it only for the purpose for which it is disclosed.

5.1. What are you agreeing to when you provide us with information?

5.2. Do you have to provide us with Personal Information?

You have no obligation to provide any information requested by us. However. We may not be able to provide you with the services you require should the provision of the service require the collection of that information, including if the collection of that information is required by law.

If you would prefer that we do not collect any Personal Information from you, please do not provide us with any such information.

5.3. What do you consent to?

By using our website, applications and services, or otherwise providing us with your personal information, you consent to us collecting, holding, using and disclosing your Personal Information as described in this Privacy Policy.

5.4. How do you withdraw your consent?

6.1. What’s a cookie?

A cookie is a piece of information that allows the server to identify and interact more effectively with your device. The cookie assists us in maintaining the continuity of your browsing session. We may use cookies on our websites.

6.2. How do we use cookies and analytics?

We and/or our contractors may use third-party analytics providers to collect data about your interaction with our websites. This data is hosted by a third party. The sole purpose of collecting this data is to improve your experience when using our websites: it does not contain personal or identifiable details.

6.3. Why do we use cookies and analytics?

These technologies are consistent across our digital services, allowing us and the other providers of these services to understand you better and provide a more consistent experience across these services. You can configure your web browser to reject cookies and block out the analytics, however, you may notice limited functionality in some parts of our digital services afterwards.

7. Direct Marketing Materials

7.1. What do we use your Personal Information for and what do you agree to?

You acknowledge that we may maintain your Personal Information in our databases, and that these databases may be used for ongoing marketing and sales-related purposes, or to advise you of the other services that we can offer.

We may send you direct marketing communications and information about offerings and services that we consider may be of interest to you as part of our marketing campaigns.

These communications may be sent in various forms, including telephone, email, post, or SMS, in accordance with applicable laws, such as the Spam Act 2004 (Cth).

We may aggregate and process Personal Information to generate new insights about our client base and network, so we can provide you with the best possible service for selling or leasing your property now or in the future.

7.2. What is EDM and how is it used?

EDM stands for electronic direct marketing. We use EDM to help connect with our clients, and other people we deal with.

We use an EDM platform called ActivePipe. If you subscribe to our newsletter any information you provide when subscribe, except Sensitive Information, will we collected by ActivePipe and used in our email marketing.

7.3. Can you opt out of marketing?

You will be given the option to opt-out of any such future approaches and to remove your personal details from our database. You can do this at any time by using the unsubscribe option in emails from us, or by contacting us on the contact details below. There is no fee for doing this.

8. Social Media

8.1. Can your information be used on social media?

We participate in social media such as LinkedIn, Twitter, Facebook, Instagram, TikTok and our website blog (Social Media). If we think it is relevant to the quality of service that we provide, we may record the essence of any topic discussed by a particular individual and their name and may contact them. We will not provide personal or identifiable details to any social media outlet without your consent.

Third party Social Media providers (Social Media Providers), also handle your Personal Information for their own purposes. These sites have their own privacy policies.

8.2. Disclaimer

While we will only provide Personal Information to Social Media Providers we cannot guarantee that your Personal Information will be kept by these Social Media Providers to same high standards that we exercise for safeguarding your information.

To the extent permitted by law we are not liable to you for any Loss suffered as a result of a leak or misuse of your Personal Information or any data you provide to us by Social Media Providers who we provide it to. 9. Changes to Our Privacy Policy

9.1. When can the Privacy Policy change and how will you know?

We may amend this Privacy Policy at any time without prior notice to you. Changes will be posted on our website[2]. We encourage you to periodically consult our Privacy Policy so that you remain informed as to how we are protecting your Personal Information.

9.2. How does this affect how we use your Personal Information?

The process of handling Personal Information will be based on the Privacy Policy in effect at the time the information is used. Your continued use of our services or websites following any such amendment will constitute confirmation of your acceptance of the amendments.
